Terms of Use

1. Who we are

These Terms of Use ("Terms") apply to ChatBoba, a multi-model AI chat workspace that lets users chat with AI models, compare model outputs, create AI Studio workflows, and manage profiles, memories, prompts, and settings.

For now, "ChatBoba," "we," "us," and "our" refer to the operators of ChatBoba. Contact us at support@chatboba.com.

2. Acceptance of these Terms

By creating an account, accessing ChatBoba, or using the service, you agree to these Terms. If you do not agree, do not use ChatBoba.

You must be old enough to use online services in your location and able to form a binding agreement. If you use ChatBoba on behalf of an organization, you represent that you have authority to accept these Terms for that organization.

3. Beta product

ChatBoba is currently in beta. Features may change, break, be removed, or behave unexpectedly. We may add or change limits, provider support, model availability, pricing-related displays, access controls, or workflows as the product evolves.

Beta access may be limited, invite-only, or revoked at any time.

4. Accounts and security

You are responsible for your account, password, sessions, API keys, and activity under your account. Keep your login details and provider keys secure. Tell us promptly if you believe your account has been compromised.

You may not share your account in a way that avoids limits, misrepresents usage, or creates security risk.

5. BYOK and provider billing

ChatBoba supports "bring your own key" usage. When you connect your own AI provider API key, you are responsible for that provider account, key permissions, usage, limits, and charges.

For BYOK usage, ChatBoba does not markup token pricing. You pay the applicable AI provider directly according to that provider's terms, pricing, and billing practices. ChatBoba may show estimated usage or cost information for convenience, but these estimates may be incomplete, delayed, or inaccurate and are not billing statements.

You are responsible for reviewing and complying with the terms and policies of providers such as OpenAI, Anthropic, xAI, Google Gemini, and any other provider you use through ChatBoba.

6. Managed AI access

ChatBoba may also offer managed or provider-hosted model access, including beta, subscription, demo, internal testing, or admin-managed access. If managed access is enabled for your account, ChatBoba may route requests to AI providers using ChatBoba-managed credentials and provider configurations.

Managed access may be limited, suspended, changed, or discontinued. Future paid plans may have additional terms.

You may not abuse, resell, automate, scrape, or exploit managed or provider-hosted access in ways that harm ChatBoba, evade limits, or create unreasonable load. Rate limits and abuse protections may apply.

7. AI outputs and user responsibility

AI-generated content can be inaccurate, incomplete, offensive, outdated, or unsuitable for your use case. You are responsible for evaluating outputs before relying on them.

ChatBoba is not a substitute for professional advice, including legal, medical, financial, safety, or other expert advice. Do not use ChatBoba as the sole basis for important decisions.

You are responsible for your prompts, uploaded or entered content, instructions, use of outputs, and any decisions or actions based on AI responses.

8. Your content

You retain ownership of content you submit to ChatBoba, including prompts, profile notes, memories, chat messages, settings, and other user content. You grant ChatBoba a limited license to host, process, transmit, display, and use that content as needed to provide, secure, maintain, and improve the service.

You represent that you have the rights needed to submit your content and that your content does not violate laws, these Terms, or others' rights.

9. Acceptable use

You agree not to use ChatBoba to:

  • break the law or violate others' rights;
  • generate or distribute malware, phishing, spam, or abusive automation;
  • attempt to access accounts, systems, data, or keys without permission;
  • harass, threaten, exploit, or harm others;
  • create or share illegal sexual content or sexual content involving minors;
  • evade safety systems, rate limits, access controls, or provider restrictions;
  • misrepresent AI-generated content as human-created where that would be deceptive or unlawful;
  • use ChatBoba in high-risk settings where failure could cause death, personal injury, property damage, or environmental harm;
  • violate the acceptable-use policies of any AI provider used through ChatBoba.

10. Third-party services

ChatBoba integrates with third-party AI providers and may depend on third-party hosting, analytics, authentication, email, storage, or infrastructure services. We do not control third-party services and are not responsible for their availability, policies, outputs, or billing.

11. Service changes and availability

We may update, suspend, limit, or discontinue parts of ChatBoba at any time. We will try to avoid unnecessary disruption, but we do not guarantee uninterrupted or error-free service.

12. Termination

You may stop using ChatBoba at any time. We may suspend or terminate access if we believe you violated these Terms, created risk, misused the service, failed to comply with provider requirements, or if we discontinue beta access.

Termination may result in loss of access to your account and stored content, subject to our Privacy Policy and any legal retention requirements.

13. Disclaimers

ChatBoba is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, and reliability.

We do not guarantee that AI outputs will be correct, safe, unique, non-infringing, or suitable for your intended use.

14. Limitation of liability

To the fullest extent permitted by law, ChatBoba and its owners, employees, contractors, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost goodwill, provider charges, or business interruption.

To the fullest extent permitted by law, our total liability for any claim related to ChatBoba will not exceed the greater of: (a) amounts you paid directly to ChatBoba in the three months before the claim, or (b) USD $100.

15. Indemnity

You agree to defend and indemnify ChatBoba from claims, losses, liabilities, damages, costs, and expenses arising from your content, use of ChatBoba, provider accounts or keys, violation of these Terms, or violation of law or third-party rights.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

17. Changes to these Terms

We may update these Terms as ChatBoba evolves. If changes are material, we will provide notice through the service, email, or another reasonable method. Continued use after changes means you accept the updated Terms.
